1. Acceptance of These Terms
Welcome to El Cajon Guitars & Music (“ECG Music,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of ECGMusic.com, including purchases made through our website.

By accessing our website, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, Shipping Policy, and Refund Policy, each of which is incorporated into these Terms by reference.

If you do not agree with these Terms, please do not use this website.

2. About El Cajon Guitars & Music
El Cajon Guitars & Music is an authorized dealer specializing in premium guitars, basses, amplifiers, effects pedals, recording equipment, musical accessories, and related music products.

We operate from El Cajon, California, serving customers throughout the United States through our online store and scheduled local pickup appointments.

Our goal is to provide knowledgeable service, carefully selected products, and an enjoyable purchasing experience for musicians of all experience levels.

3. Appointment-Only Showroom and Local Pickup
El Cajon Guitars & Music operates by appointment only. We do not maintain regular walk-in retail hours.

Local pickup is available by scheduled appointment for completed online orders. Customers must wait for confirmation that an order is ready before arriving for pickup.

Identification, order confirmation, payment verification, or the payment card used for the transaction may be required at pickup. We reserve the right to decline release of an order when identity or payment authorization cannot be reasonably verified.

4. Authorized Dealer Status
El Cajon Guitars & Music is an authorized dealer for the manufacturers we represent.

Manufacturer warranties apply according to each manufacturer’s published terms, eligibility requirements, exclusions, and claim procedures. Warranty coverage may not apply to products purchased from unauthorized sellers.

Customers are welcome to contact us before purchasing with questions about warranty eligibility.

5. Products and Product Information
We make reasonable efforts to provide accurate product descriptions, specifications, prices, availability information, and photographs.

Manufacturers may revise specifications, components, included accessories, packaging, finishes, country of manufacture, or other details without advance notice. Manufacturer-provided information may occasionally be incomplete, revised, or outdated.

Customers seeking confirmation of a specific feature, component, finish, production version, serial number, included accessory, or other material detail must contact us before placing an order.

6. Product Photography
Some listings feature photographs of the actual instrument or item being offered. Other listings use manufacturer-supplied images for new inventory.

When a listing identifies “Actual Instrument Shown,” the customer will receive the exact instrument pictured.

When manufacturer-supplied images are used, the product will substantially conform to the manufacturer’s specifications, but natural cosmetic variation may occur.

Lighting, screen settings, photography, image processing, and manufacturing variation may affect how colors and finishes appear online.

7. Natural Materials and Cosmetic Variation
Many musical instruments are made from natural materials.

Wood grain, figuring, color, mineral streaks, texture, binding, finish appearance, and other natural characteristics may vary from one instrument to another. These variations are not defects and are part of what makes each instrument unique.

Minor finish, grain, or cosmetic differences between a product and manufacturer-supplied photographs do not establish that the product is defective or materially misrepresented.

8. Product Availability
We make reasonable efforts to maintain accurate inventory information.

Because products may also be sold through marketplace channels, supplier inventory feeds, direct customer transactions, or other sales platforms, availability cannot be guaranteed until an order has been accepted and processed.

An item may occasionally become unavailable after an order is submitted. If this occurs, we will notify the customer promptly and provide available options, including a full refund when appropriate.

Supplier inventory, expected delivery dates, and backorder estimates remain subject to confirmation and may change without notice.

9. Pricing
All prices are stated in U.S. dollars unless otherwise indicated.

Prices, promotions, shipping charges, and availability may change without notice. Pricing offered through ECGMusic.com may differ from pricing offered through third-party marketplaces because of marketplace fees, shipping arrangements, promotions, or platform requirements.

Although we strive for accuracy, pricing, typographical, supplier, inventory, or publishing errors may occur. We reserve the right to correct an error or cancel an affected order, including after the order has been submitted.

If an error materially affects an order, we will notify the customer and provide the option to proceed under the corrected terms or receive a full refund.

10. Orders and Payment
Submitting an order does not guarantee acceptance.

By placing an order, the customer represents that the information provided is accurate, that the customer is legally authorized to complete the transaction, and that the payment method is being used with the account holder’s permission.

We reserve the right to refuse, limit, hold, verify, or cancel an order for reasons including:

  • Pricing or inventory errors
  • Suspected fraud or unauthorized payment activity
  • Payment authorization problems
  • Supplier unavailability
  • Shipping restrictions
  • Incomplete or inconsistent customer information
  • Excessive transaction risk
  • Violation of these Terms

An order is accepted only after payment has been authorized and the order has been approved for processing.

11. Special Orders and Custom Orders
Products identified as special order, custom order, made to order, personalized, or non-stock merchandise may require a deposit, full advance payment, extended lead time, or manufacturer production schedule.

Unless expressly agreed otherwise in writing, special-order and custom-order merchandise becomes non-cancelable and non-returnable once the order has been submitted to the manufacturer or supplier.

Quoted production and delivery dates are estimates and are not guaranteed. Manufacturer delays, material shortages, transportation interruptions, and other circumstances outside our control may affect completion or delivery.

12. Shipping
Orders are packaged carefully and shipped through reputable carriers. Shipping methods, charges, insurance, estimated transit times, signature requirements, and related conditions are further described in our Shipping Policy.

Customers are responsible for providing complete and accurate shipping information. Additional charges resulting from an incorrect, incomplete, undeliverable, or changed address may be the customer’s responsibility.

Processing and carrier transit times may be longer during peak shopping periods, holiday seasons, severe weather, carrier disruptions, and other high-volume periods. Customers should order well in advance of holidays, birthdays, performances, travel, recording sessions, and other time-sensitive occasions.

Expedited processing or expedited shipping may be available at an additional cost to the customer. However, expedited service does not guarantee delivery by a specific date. Carrier delays, weather, address problems, service interruptions, and other circumstances beyond our reasonable control may affect delivery.

El Cajon Guitars & Music is not responsible for carrier delays or other delivery interruptions outside our reasonable control.

13. Shipping Damage and Delivery Inspection
At the time of delivery, the customer must inspect the condition of the shipping carton before accepting or opening the package. Any visible crushing, punctures, tears, moisture, impact damage, or other signs of mishandling must be photographed and documented immediately.

If the carrier’s delivery representative is present, the customer must ask the driver to note any visible damage in the carrier’s delivery record. The customer must retain the shipping carton, internal packing materials, shipping labels, and all related documentation until the matter is fully resolved.

El Cajon Guitars & Music inspects products before shipment and ships them in new condition or in the condition accurately described in the applicable product listing. Nevertheless, products may be damaged or rendered nonfunctional during transit.

If an item arrives damaged or nonfunctional, the customer must notify El Cajon Guitars & Music within 48 hours of delivery and provide clear photographs of:

  • The exterior shipping carton
  • Any visible carton damage
  • The shipping label
  • The internal packaging
  • The complete product
  • The specific damage or condition being reported

Transit-related claims will first be addressed through the applicable carrier insurance or claims process. The customer must cooperate fully with reasonable documentation, inspection, pickup, return, or claim requirements.

Failure to document visible shipping damage, retain the original packaging, or notify El Cajon Guitars & Music within 48 hours may invalidate the carrier claim and any assertion that the product arrived damaged. In such circumstances, a damage-related return to El Cajon Guitars & Music may be refused.

This provision does not limit rights that cannot legally be waived under applicable law.

After the shipping-damage reporting period, or when the reported issue is determined not to have resulted from transit, any applicable manufacturer warranty may govern the available remedy.

14. Tube Amplifiers
Vacuum tubes are consumable electronic components and may occasionally fail during shipping or normal use.

If a tube amplifier has been exposed to extreme heat or cold during transit, the customer must allow the amplifier to reach room temperature before connecting it to power or turning it on.

Tube replacement is considered normal maintenance and does not, by itself, establish that an amplifier is defective.

Customers must follow manufacturer instructions concerning speaker connections, impedance, ventilation, voltage, grounding, and safe operation.

15. Returns, Refunds, Cancellations, and Exchanges
Returns, refunds, cancellations, exchanges, order changes, restocking conditions, cancellation fees, and non-returnable merchandise are governed by our Refund Policy, which is incorporated into these Terms by reference.

Customers must review the Refund Policy before purchasing. Except where prohibited by law, placing an order constitutes acceptance of the return, cancellation, and refund conditions published on our website at the time of purchase.

Nothing in these Terms or our Refund Policy limits rights that cannot legally be waived.

16. Used, Vintage, Open-Box, Demo, and Previously Handled Merchandise
Products identified as used, vintage, open-box, demo, display, blemished, previously handled, or otherwise not factory-sealed are sold in the condition described in the applicable listing.

Customers must review the complete listing, photographs, condition disclosures, included accessories, and any identified limitations before purchasing.

Normal cosmetic wear, handling marks, finish variation, age-related characteristics, replaced components, setup preferences, or other disclosed conditions are not shipping damage or product misrepresentation.

Unless expressly stated otherwise in writing, used and vintage products do not include a new-product manufacturer warranty.

17. Instrument Setup, Playability, and Personal Preference
Musical instruments are affected by temperature, humidity, altitude, transportation, string choice, playing style, and individual setup preference.

An instrument may require adjustment after delivery, including tuning, truss-rod adjustment, action adjustment, intonation, pickup-height adjustment, or other routine setup work.

Preferences concerning neck relief, string height, fret feel, tone, weight, balance, finish appearance, or general playability are subjective and do not, by themselves, establish that an instrument is defective.

Unless expressly stated otherwise, routine setup work and adjustments made to suit the customer’s personal preferences are the customer’s responsibility.

18. Manufacturer Specifications and Product Changes
Manufacturers may change specifications, materials, components, packaging, accessories, finishes, model-year details, or manufacturing locations without advance notice.

We make reasonable efforts to maintain current information, but minor specification changes that do not materially alter the identity or intended function of a product do not automatically create a right to cancellation, return, replacement, or compensation.

Customers who require a specific component, production version, feature, accessory, serial number, or other detail must obtain confirmation before ordering.

19. Manufacturer Warranties
New products may include a manufacturer warranty when offered by the applicable manufacturer and when eligibility requirements are satisfied.

Manufacturer warranties are provided and administered by the manufacturer, not by El Cajon Guitars & Music. Warranty duration, transferability, registration requirements, geographic limitations, exclusions, available remedies, shipping obligations, and service procedures vary by manufacturer.

The customer is responsible for reviewing and complying with the manufacturer’s warranty requirements, including registration deadlines when applicable.

We will make reasonable efforts to assist customers in identifying the appropriate manufacturer contact or warranty process. However, we cannot approve, deny, extend, modify, or guarantee a manufacturer warranty claim.

Nothing in these Terms eliminates warranty rights that cannot legally be waived.

20. Extended Service Plans and Third-Party Coverage
Optional accidental-damage plans, extended service contracts, protection plans, financing products, insurance products, or other third-party services may be offered in connection with certain purchases.

These services are governed by the issuing company’s separate terms, exclusions, claim procedures, and coverage limitations.

El Cajon Guitars & Music does not independently administer or guarantee third-party coverage. Claims must be directed to the applicable plan administrator unless otherwise stated.

Purchasing third-party coverage does not alter our Refund Policy or create additional return rights through El Cajon Guitars & Music.

21. Product Use, Maintenance, and Safety
Customers are responsible for using, storing, transporting, maintaining, connecting, installing, and operating products in accordance with manufacturer instructions and accepted safety practices.

Musical instruments and electronic equipment may require appropriate humidity control, temperature control, voltage, grounding, ventilation, amplification, cabling, power supplies, installation, maintenance, and professional service.

El Cajon Guitars & Music is not responsible for damage caused by misuse, abuse, neglect, improper storage, unsuitable humidity, temperature exposure, unauthorized modification, incorrect voltage, incompatible power supplies, improper installation, accidental damage, or failure to follow manufacturer instructions.

Repairs involving electrical components, mains voltage, amplifiers, speakers, batteries, or structural instrument work should be performed by a qualified technician.

22. Order Verification and Fraud Prevention
To protect customers and our business, we may review, delay, limit, or cancel an order when additional verification is reasonably required.

Verification may include confirming billing information, shipping information, identity, payment authorization, purchaser contact information, or other transaction details.

We may require delivery to a verified address, an adult signature, identification at pickup, or additional documentation for certain high-value or higher-risk transactions.

Failure to provide requested verification may result in cancellation and refund of the order.

We reserve the right to refuse transactions that appear fraudulent, unauthorized, unusually risky, intended for prohibited resale or export, or inconsistent with payment-provider requirements.

23. Payment Disputes and Chargebacks
Customers experiencing a concern with an order should contact El Cajon Guitars & Music promptly so that we have a reasonable opportunity to investigate and resolve the matter.

Initiating a chargeback or payment dispute does not eliminate the customer’s responsibility to comply with these Terms, cooperate with carrier or warranty investigations, preserve relevant evidence, return merchandise when required, or provide accurate information to the payment provider.

We reserve the right to provide order records, communications, delivery confirmation, photographs, inspection records, policy acknowledgments, and other relevant documentation to banks, payment processors, carriers, insurers, marketplaces, law-enforcement agencies, or other parties involved in investigating a dispute.

Nothing in this section prevents a customer from exercising legitimate payment-dispute rights provided by law.

24. Third-Party Marketplaces and Supplier-Fulfilled Products
Products purchased through a third-party marketplace may also be subject to that marketplace’s terms, payment procedures, shipping requirements, dispute processes, and buyer-protection rules.

When marketplace rules apply to a transaction, those rules may control to the extent required by the platform.

Some products may be shipped directly by an authorized manufacturer, distributor, or supplier. Packaging, tracking, delivery methods, return instructions, inventory availability, and warranty procedures for supplier-fulfilled products may differ from products shipped directly by El Cajon Guitars & Music.

Supplier-fulfilled status does not guarantee immediate availability or delivery by a specific date.

25. Intellectual Property
The ECGMusic.com website and its original content—including photographs, product photography, written descriptions, graphics, logos, page designs, videos, and other materials—are owned by or licensed to El Cajon Guitars & Music and are protected by applicable intellectual-property laws.

Manufacturer names, logos, product images, and trademarks remain the property of their respective owners and are used for legitimate identification, promotion, and authorized resale purposes.

Website content may not be copied, reproduced, republished, distributed, scraped, altered, commercially exploited, or used to create competing listings without prior written permission, except as permitted by law.

26. Third-Party Links and Services
Our website may contain links to manufacturers, payment providers, financing providers, shipping carriers, review platforms, social-media services, marketplaces, or other third parties.

We do not control third-party websites and are not responsible for their content, availability, privacy practices, security, representations, or performance.

Use of a third-party service is subject to that party’s own terms and policies.

27. Website Availability and Errors
We do not guarantee that ECGMusic.com will always be available, uninterrupted, secure, or free from errors.

We may update, suspend, restrict, or discontinue portions of the website without notice for maintenance, security, operational, legal, or business reasons.

We are not responsible for delays or losses caused by internet outages, software errors, platform failures, cyber incidents, payment-system interruptions, or other events outside our reasonable control.

28. Limitation of Liability
To the fullest extent permitted by law, El Cajon Guitars & Music will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the purchase, possession, use, misuse, installation, failure, delay, or unavailability of a product or service.

This includes, without limitation, loss of income, performance opportunities, recordings, data, business, profits, reputation, travel expenses, substitute-equipment costs, or other collateral losses.

To the fullest extent permitted by law, our total liability arising from a transaction will not exceed the amount actually paid to El Cajon Guitars & Music for the product giving rise to the claim.

These limitations do not apply where prohibited by law and do not exclude liability that cannot legally be limited.

29. Indemnification
To the extent permitted by law, the customer agrees to indemnify and hold harmless El Cajon Guitars & Music and its owners, employees, representatives, contractors, and service providers from third-party claims, damages, liabilities, and reasonable expenses arising from:

  • Misuse of a product
  • Unlawful conduct
  • Unauthorized resale or export
  • Violation of these Terms
  • Infringement of another person’s rights
  • False or misleading information supplied in connection with an order or dispute

This section does not require a customer to indemnify El Cajon Guitars & Music for our own unlawful conduct or for obligations that cannot legally be transferred.

30. Force Majeure
El Cajon Guitars & Music is not responsible for failure or delay caused by circumstances beyond our reasonable control.

Such circumstances may include severe weather, fire, flood, earthquake, natural disaster, epidemic, pandemic, labor disruption, civil unrest, war, terrorism, government action, embargo, transportation interruption, carrier delay, supplier shutdown, manufacturing delay, port congestion, power failure, internet outage, cyber incident, or widespread service disruption.

When such an event occurs, affected obligations will be suspended for the period reasonably necessary.

31. Privacy
Our collection, use, and handling of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the website or placing an order, the customer acknowledges that transaction information may be processed by Shopify, payment providers, shipping carriers, fraud-prevention providers, service-plan administrators, and other parties reasonably necessary to complete and protect the transaction.

32. Governing Law and Venue
These Terms and transactions made through ECGMusic.com are governed by the laws of the State of California, without regard to conflict-of-law principles.

Subject to consumer rights or venue requirements that cannot legally be waived, disputes arising from these Terms or a transaction with El Cajon Guitars & Music shall be brought in an appropriate state or federal court located in San Diego County, California.

33. Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the greatest extent legally permitted or severed when necessary.

The remaining provisions will continue in full force and effect.

34. No Waiver
Failure by El Cajon Guitars & Music to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

A waiver is valid only when expressly made in writing by an authorized representative of El Cajon Guitars & Music.

35. Entire Agreement
These Terms, together with our Refund Policy, Shipping Policy, Privacy Policy, the applicable product listing, the order confirmation, and any written terms specifically agreed to for a transaction, constitute the agreement between the customer and El Cajon Guitars & Music concerning that transaction.

If a product listing contains a specific condition disclosure, final-sale term, special-order term, or other transaction-specific requirement that differs from a general provision in these Terms, the more specific transaction disclosure will control to the extent permitted by law.

36. Changes to These Terms
We may revise these Terms periodically.

Changes become effective when posted on ECGMusic.com unless a later effective date is stated.

The version in effect when an order is placed will generally govern that transaction, except when a change is required by law or expressly accepted by the customer.
